MANILA, Philippines -- A bill criminalizing the recording of ?private act or acts and other violations of the privacy of an individual? by means of mobile phones or video cameras has been filed at the House of Representatives.
House Bill 4315 or ?An act to prohibit and penalize the recording of private acts or acts and other violations of the privacy of an individual, and for other purposes? were initiated by Buhay Partylist Representatives Irwin Tieng, Rene Velarde, and Ma. Carissa Coscolluela.
The bill also prohibits the recording of other violations of the privacy of an individual, which will cause public ridicule without the consent of the parties.
?And if there is consent in the recording, there is no assent to its sharing, showing or exhibition to other persons,? they said in their explanatory note.
?This is considered the highest form of invasion to the privacy of the offended party. Such violation is condemnable and needs to be penalized in its highest degree,? they further said.
It will also be unlawful for any person to ?knowingly posses,? share, relay or exhibit any video recording of any private act secured either before or after the effectivity of this measure.
A penalty of up to six years imprisonment and a fine of up to P500,000 awaits those who will violate the proposed legislation.
In a separate statement, Tieng expressed apprehension on the increasing number of high school or college students, whose sexual acts have been featured in amateur sex-video clips.
?What is more disgusting is that these recordings are caused by or without authority of lovers or partners. Whether it is triggered by a lovers? revenge or just cheap publicity stunt, the same is against morality and ethics,? he said.
